Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") are a binding agreement between you and REALTRACK TECHNOLOGIES L.L.C ("RealTrack", "we", "us"), a company based at Office 1606, The Binary by Omniyat, Business Bay, P.O. Box 33221, Dubai, UAE, providing AI-driven solutions for the real estate sector. They govern your access to and use of realtrack.ae and our services. If you're using our services on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

2. Use of the services

• You must be at least 18 years old and able to form a binding contract.
• You agree to use the services only for lawful purposes and in line with these Terms and any customer agreement we sign with you.
• You are responsible for keeping your account credentials secure and for all activity under your account.

3. Acceptable use

You agree not to:

• Reverse engineer, resell, or copy the services except as permitted by law or your agreement with us.
• Upload unlawful, infringing, or harmful content, or data you have no right to process.
• Interfere with the integrity or performance of the services, or attempt to gain unauthorised access.
• Use the services to build a competing product or to violate anyone's rights or privacy.

4. Your data & content

You retain all rights to the data and content you connect to or upload to the platform. You grant us the limited licence needed to host, process, and display that data so we can provide the services. How we handle personal data is described in our Privacy Policy.

5. Intellectual property

The services, including the software, models, designs, and the RealTrack name and logo, are owned by RealTrack and protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the services.

6. Fees

Paid features are billed as described in your order or subscription. Unless stated otherwise, fees are non-refundable and exclusive of taxes. We'll give reasonable notice before any change to recurring pricing.

7. Service availability

We work to keep the services reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the services, and will give reasonable notice of material changes where we can.

8. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Outputs from AI and predictive systems are provided to support your decisions, not to replace your own judgement.

9. Limitation of liability

To the maximum extent permitted by law, RealTrack will not be liable for any indirect, incidental, or consequential damages, or for lost profits or data. Our total liability arising out of the services will not exceed the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the services at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, the rights granted to you end, and sections that by their nature should survive will continue to apply.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction of the competent courts of the UAE, unless your customer agreement states otherwise.
